Terms of Service

These Terms of Service ("Terms") govern your use of Teclogically AI's services, including Teclogically Answer, CardIQ, SpendIQ, CiteIQ, AccessIQ, BidIQ, and the HVAC Lead Response service (collectively, the "Services"), operated by Teclogically AI ("we," "us," or "our"). By submitting an intake form, making a payment, or using any of our Services, you agree to these Terms.

1. Services Description

Teclogically AI provides AI-powered business automation and consulting services for small and medium-sized businesses. Services are delivered asynchronously and digitally. Specific capabilities, deliverables, and timelines are described on each product's landing page and confirmed in writing at the time of engagement.

2. Teclogically Answer — AI Voice Agent

Teclogically Answer is a subscription service that provides a 24/7 AI voice agent for your business. By subscribing, you acknowledge and agree to the following:

• Call Recording: All calls handled by your AI agent may be recorded for quality, training, and scheduling purposes. A disclosure is played at the start of every call.
• AI Disclosure: Your AI agent is a virtual assistant, not a human. We recommend your greeting identifies it as such.
• Phone Number Ownership: Dedicated phone numbers provisioned for your account are licensed through our telephony provider. Numbers may not be transferred to another carrier mid-contract without advance notice.
• Call Minutes: Monthly minute allowances are calculated from the first day of each billing cycle. Overages are billed at the per-minute rate for your plan.
• Google Calendar: Calendar integration requires your authorization. You may revoke access at any time, which will disable appointment booking functionality.

3. Payment Terms

• A one-time setup fee is due before provisioning begins. Subscriptions are billed monthly on the anniversary of activation.
• Annual prepay plans waive the setup fee and lock in the current monthly rate for 12 months.
• Overages are billed in arrears on the following month's invoice.
• All payments are non-refundable except as described in Section 5 (Guarantee).

4. Cancellation

You may cancel any subscription with 30 days written notice to info@teclogicallyai.com. Your service remains active through the end of the notice period. No partial-month refunds are issued.

5. Satisfaction Guarantee

For SpendIQ and CardIQ audits: if our analysis does not identify at least $500 in annualized savings potential, we will issue a full refund. Refund requests must be made within 14 days of report delivery.

For Teclogically Answer: if your AI agent is not live within 5 business days of receiving your completed intake form and setup fee payment, we will refund the setup fee in full.

6. Acceptable Use

You agree not to use our Services to:

• Violate any applicable law or regulation
• Harass, deceive, or defraud callers or third parties
• Collect personal information from callers in violation of applicable privacy laws
• Represent the AI agent as a licensed professional (attorney, medical professional, financial advisor) when it is not

7. Data & Privacy

We collect and process data as described in our Privacy Policy. Call recordings, transcripts, and caller information are treated as confidential and are not shared with third parties except as required to deliver the Services (e.g., our telephony provider).

8. Disclaimer of Warranties

Services are provided "as is." We do not guarantee that the AI agent will answer every call perfectly, that all appointments will be booked without error, or that call summaries will be 100% accurate. AI outputs should be reviewed by you as the business owner.

9. Limitation of Liability

To the maximum extent permitted by law, Teclogically AI's total liability for any claim arising from these Services shall not exceed the total fees paid by you in the 3 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in the courts of Nash County, North Carolina.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Services after that date constitutes acceptance.
